E-Statement Disclosure Agreement

ELECTRONIC DELIVERY OF STATEMENTS - Before you can access our Electronic Statement Services ("e-Statement Services"), regulations require us to obtain your affirmative consent to electronic delivery of your periodic account statements and associated disclosures. Please read this Electronic Statement Disclosure Agreement carefully and save or print a copy for your records.

HARDWARE AND SOFTWARE REQUIREMENTS - You must have a computer with access to the Internet through an Internet Service Provider (ISP). You need an operating system (Microsoft® Windows 98 or higher, or IMac® Operating System or higher) and a browser (Netscape® 4.7 or higher, Microsoft® Internet Explorer 5.0 or higher, or America Online Web Browser 5.0 or higher). HFS Federal Credit Union is not responsible for any loss, damage or claim caused by your ISP, software, or computer communication equipment. If there is a change in the hardware/software requirements associated with this service, we will notify you and provide an explanation of the updated hardware/software requirements. It is your sole responsibility to insure your personal computer and related equipment are compatible with and capable of operating in a manner that allows you to utilize the e-Statement Service. If you cannot meet the requirements for any reason, you have the right to withdraw your consent at that time at no cost to you. Withdrawing your consent will terminate your e-Statement Service.

CONSENT TO ELECTRONIC DELIVERY OF ACCOUNT STATEMENTS - Once you consent to the HFS Federal Credit Union's e-Statement Service, you agree that the Credit Union WILL NOT provide you with monthly, printed account statements by mail to your postal address on record. Instead, each month we will send an e-mail notice to you advising you of the availability of your e-Statement. You will be required to access the HFS Federal Credit Union online banking website at www.hfsfcu.org in order to view your statement. Statement notifications may be sent to only one e-mail address. For example, the notification cannot go to both a work and home e-mail address. If you have more than one HFS Federal Credit Union account under a separate member number, you will need to submit a request for each account. Account statements and other disclosures sent to you through the Credit Union's e-Statement Service may only be available online for 12 months; therefore, you should print out or otherwise electronically retain account statements and other disclosures regularly. Generally your e-Statement is available within 2 - 5 business days after the month-end processing is completed.

CHANGE OF E-MAIL ADDRESS - You agree that it is your responsibility to keep the HFS Federal Credit Union informed of any change in your e-mail address. Upon accessing your online banking account, you may update your e-mail address by clicking on the link "PREFERENCES". If the Credit Union sends you an e-mail notification and it is returned as undeliverable, the Credit Union will attempt to contact you by posting an "alert message" via Online Banking alert center. You agree that if we receive notice that our e-mail notice to you is undeliverable and we do not obtain an updated e-mail address from you, we may terminate your participation in the HFS Federal Credit Union's e-Statement Service and mail subsequent statements to your postal address of record.

WITHDRAWAL OF CONSENT - Your consent to receive electronic delivery of your statements shall remain in effect until revoked by you. You have the right to terminate your e-Statement access and receive paper statements by postal mail at any time upon notice to HFS Federal Credit Union. If you wish to cancel e-Statements and resume receipt of paper statements, you may select the e-Statement option under "PREFERENCES" and change the option to "US MAIL" or you may call or send us an e-mail at hfs_operations@hfsfcu.org advising us of your intent to cancel electronic delivery, by requesting the change at any of our branch offices, or by mailing a request to HFS Federal Credit Union at 632 Kinoole Street, Hilo HI 96720-3894.

CONFIDENTIALITY - You agree to protect the confidentiality of your account, account number, and your personal identification number.

OTHER ACCOUNT RELATED INFORMATION - We often include with your paper account statement other periodic notices that relates to account notices or regulatory information, otherwise known as statement inserts. When you agree to accept electronic statements, you also agree to receive other notices by electronic delivery.

SERVICE AVAILABILITY - The service providing e-Statement is generally available 24 hours a day, 7 days a week, however this service may be unavailable from time to time for routine software and hardware maintenance, or due to unscheduled down time.

CONTACTING THE CREDIT UNION BY E-MAIL - HFS Federal Credit Union may not immediately receive and review e-mail messages that it receives. The Credit Union will not take action based on e-mail requests until a Credit Union employee actually reviews the message and has a reasonable opportunity to act. CHANGE IN TERMS - We may change any term of this Agreement at any time. If the change would result in increased fees for any HFS Federal Credit Union service, or increased liability to you, we will provide any required notice of the change in terms to you by e-mail or by postal mail. If advance notice of the change is not required, we will notify you of the change in terms within 30 days after the change becomes effective. If there is more than one party to the account, notice to any one-account owner will be effective for all.

IN CASE OF ERRORS OR QUESTIONS ABOUT YOUR ELECTRONIC STATEMENT - You have a duty to exercise reasonable promptness in examining your e-Statement to determine whether any transaction appearing on your statement was not authorized. If you believe that an unauthorized transaction has been conducted from your account without your permission, contact us IMMEDIATELY. You may notify us at (808) 930-1400 for the Island of Hawai'i, (800) 216-2666 for Neighbor Islands and Continental USA, or write to us at: HFS Federal Credit Union, 632 Kinoole Street, Hilo HI 96720-3894. We must hear from you no later than sixty (60) days after we sent the FIRST statement on which the problem or error appeared. Tell us your name and account number, the dollar amount of the suspected error, and the date it occurred. Describe the error or the transaction you are unsure about, and explain as clearly as you can, why you believe it is an error or why you need more information.

ACCEPTANCE OF E-STATEMENT AGREEMENT AND CONSENT TO RECEIVE ELECTRONIC DISCLOSURES - Clicking on the "CHANGE" button constitutes your written signature and consent to be bound by the terms of this Electronic Statement Disclosure Agreement and to receive Statements electronically.
